VanHeartbeat is an independent, automated public telemetry aggregator. All tools, metrics, calculations, badges, and alerts are provided strictly on an "AS IS" and "AS AVAILABLE" basis. The creators, operators, and contributors of VanHeartbeat bear NO RESPONSIBILITY OR LIABILITY for any actions taken, decisions made, losses incurred, fines, towing costs, injuries, health consequences, or damages resulting from reliance on this platform.
1. Acceptance of Terms
By accessing or using the VanHeartbeat website (vanheartbeat.ca) and any associated sub-routes, APIs, or Progressive Web App (PWA) features (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions, you must immediately discontinue use of the Service.
2. Disclaimer of Warranties ("AS IS" & "AS AVAILABLE")
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties regarding the accuracy, completeness, currency, reliability, or timeliness of any telemetry, sensor data, bacterial readings, wait times, transit schedules, traffic cameras, or weather alerts;
- Warranties that the Service will operate uninterrupted, secure, or error-free at any particular time or location.
3. Strict Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL VANHEARTBEAT, ITS DEVELOPERS, MAINTAINERS, AFFILIATES, OR DATA LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
Any adverse health events, delays in seeking emergency medical attention, illness from natural water exposure, or reliance on emergency room / urgent care wait-time estimates.
Any municipal parking tickets, impound/towing fees, rush-hour lane violations, leaf-cleaning tickets, or car-share drop-off penalties incurred.
Missed ferry sailings, standby queue cutoffs, flight delays, bridge traffic gridlock, bus/SkyTrain disruptions, or travel expenses.
Any backcountry incidents, avalanche exposure, hypothermia, sudden mountain weather shifts, or vehicular tire/chain regulation infractions.
4. Specific Civic Telemetry Disclaimers
🌊 Water Quality & Swimming Safety (/swim)
Water quality assessments represent historical laboratory sample results published periodically by Vancouver Coastal Health (VCH) and Fraser Health. Water conditions at ocean beaches and freshwater lakes can fluctuate rapidly due to tides, rainfall runoff, storm outfalls, wildlife, or sudden contamination events. Always obey physical beach warning signs, lifeguard instructions, and official health notices before entering the water.
🏥 Healthcare & Emergency Wait Times (/health)
Wait times and triage estimates are approximate calculations provided by health authorities and do NOT guarantee physician availability. IN CASE OF A MEDICAL EMERGENCY (CHEST PAIN, STROKE SYMPTOMS, SEVERE TRAUMA, SHORTNESS OF BREATH), IMMEDIATELY DIAL 911 OR GO TO THE NEAREST EMERGENCY DEPARTMENT REGARDLESS OF POSTED WAIT TIMES.
🚗 Parking & Street Sweeping Radar (/parking)
Parking clearance statuses and street sweeping schedules are informational approximations derived from municipal GIS datasets and car-share guidelines. Physical curbside signage, posted temporary "No Stopping" notices, emergency closures, and City of Vancouver Street Bylaws strictly supersede all information displayed on VanHeartbeat. Users remain solely responsible for verifying physical signage before leaving a vehicle.

5. Non-Affiliation with Government or Transport Authorities
VanHeartbeat is an independent civic telemetry network. VanHeartbeat is NOT affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with:
- City of Vancouver, City of North Vancouver, City of Burnaby, City of Richmond, City of Surrey, or any municipal entity;
- Metro Vancouver Regional District (MVRD);
- Vancouver Coastal Health Authority (VCH) or Fraser Health Authority;
- British Columbia Ferry Services Inc. (BC Ferries) or Hullo (Vancouver Island Ferry Company);
- TransLink (South Coast British Columbia Transportation Authority);
- DriveBC or the BC Ministry of Transportation and Infrastructure (MOTI);
- Environment and Climate Change Canada (ECCC) or Avalanche Canada;

You agree to defend, indemnify, and hold harmless VanHeartbeat, its creators, operators, and contributors from and against any claims, actions, demands, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to your use or misuse of the Service, your violation of these Terms, or your reliance on any telemetry presented.
7. Governing Law & Jurisdiction
These Terms of Service and any disputes arising from your use of the Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
